The case of Dummitt v. A.W. Chesterton involved a U.S. Navy veteran who claimed that he was exposed to asbestos while repairing valves aboard seven U.S. Navy ships, between 1960 and 1977. The case resulted in a $32 million verdict.
The 68-year-old Dummitt was diagnosed with pleural mesothelioma, an incurable form of cancer, as a result of the exposure.
The jury determined that the defendant, in failing to warn, acted with reckless disregard for the safety of others.
In Konstantin v. 630 Third Avenue Associates, the plaintiff claimed to have inhaled asbestos released from joint-sealing compounds while working on the construction of a high-rise building in Manhattan between 1976 and 1977. A $19.5 million verdict was awarded in that case.
The jury determined that the plaintiff was exposed to asbestos at two construction sites between 1974 and 1977, when drywall subcontractors sanded joint compound that contained asbestos and other laborers swept up the dust.
