Local 91 members, who are affiliated with the Laborers’ International Union of North America, were regularly exposed to asbestos while on jobsites. Laborers’ Local 91 represents workers in Niagara County. The union was originally established as the International Hod Carriers’ Building and Common Laborers’ Union of America. Local 91 laborers worked on construction and industrial projects, asbestos removal, hazardous materials abatement, paving roads and runways, pipe installation, and bridge and building construction. These laborers worked on projects including the Niagara Hydro-Electric Power Generating Station, AES Somerset Electric Generating Station, the Seneca Niagara Hotel and Casino, and the Yahoo Data Center, amongst others.
Before the 1970s, Local 91 laborers were exposed to asbestos on jobsites. By working closely with other tradesman, including insulators, carpenters, electricians and fireproofers, Local 91 laborers regularly came into contact with asbestos. These workers came into contact with asbestos pipe covering, block insulation, roof shingles, joint compound, and fireproof materials.
Local 91 Laborers were present when fireproofing was applied to structural steel and were tasked with sweeping up asbestos dust after drywall finishers sanded asbestos joint compound. These laborers did not wear protective gear. Consequently, many of our clients who were Local 91 laborers are now being diagnosed with malignant mesothelioma and lung cancer.
Asbestos is dangerous because its fibers are extremely fragile and break easily into tiny particles that your body’s air filtration system can’t trap and expel. When asbestos gets into your lungs and stays there, it can cause mesothelioma or lung cancer. Risk of diagnosis increases with the length of time that a person has been exposed although even short exposures can cause mesothelioma or lung cancer. The most common causes of asbestos exposure are in the workplace or from products in the home.
Mesothelioma is a rare disease that is diagnosed between 2,500 and 3,000 times each year. Anyone who has been exposed to asbestos is at risk for developing mesothelioma or lung cancer. Although most companies knew that asbestos was dangerous, they continued to allow their employees to work with and around asbestos without protective gear until the late 1970s.
