Blow to Fox News in wrongful death case of slain Ukrainian journalist
Fox News’ attempt to remove the case to federal court is rejected the SDNY

New York – Today, Belluck & Fox LLP announced the win for its clients in a wrongful death case against Fox News. In a blow to Fox News and related defendants (Kuvshynov et al v. Fox News Network, LLC et al), today the Southern District of New York issued an order granting the motion to remand the case back to New York state court after Fox News attempted to remove it to federal court. The court concluded that defendants did not establish that the case should be litigated in federal court, and sent it back to New York County Supreme Court, where it was originally filed.
“This gives our clients the ability to pursue justice in the forum of their choosing,” said partner Seth Dymond, the Belluck & Fox attorney representing the journalist’s parents, who successfully argued for the remand of the case to New York state court.
The lawsuit alleges that Fox News and related defendants endangered the young Ukrainian journalist Oleksandra Kuvshynova by knowingly sending her crew into the active war zone against the advice of security professionals, where she was ultimately killed on March 14, 2022, approximately one month following the Russian invasion of Ukraine. The lawsuit further alleges that Fox News and others attempted to cover up the events after inducing Kuvshynova’s parents to enter into a settlement agreement regarding their daughter’s death.
